These Terms and Conditions (“Terms”) govern your access to and use of the website and coaching services (the “Services”) provided by Tracey Sonneborn, DBA THELÉMA LIFE COACHING (“Company,” “we,” “us,” or “our”), a life coaching business based in California, USA.

1. Acceptance of Terms

By accessing or using this website, booking or purchasing coaching services, submitting forms, communicating with us electronically, or otherwise engaging with the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and any policies incorporated by reference, including our Privacy Policy and Professional Coaching Disclaimer.

If you do not agree to these Terms, you may not access or use the website or Services.

2. Nature of Coaching Services (Not Therapy)

The Services provided are professional life coaching services delivered on a one-on-one basis.

You acknowledge and agree that:

  • Life coaching is not therapy, counseling, psychology, psychiatry, or medical treatment

  • We do not diagnose, treat, or cure any mental health or medical conditions

  • The Services do not constitute medical, psychological, legal, or financial advice

  • Coaching is not a substitute for licensed healthcare, mental health, or emergency services

Use of the Services does not create a therapist–client, doctor–patient, or other licensed professional relationship.

If you are experiencing mental health concerns, emotional distress, or a medical emergency, you are encouraged to seek assistance from a licensed healthcare professional or emergency services.

3. No Guarantee of Results

You understand and agree that:

  • Coaching outcomes depend on your individual effort, commitment, and circumstances

  • We make no guarantees regarding specific outcomes, personal transformation, income, relationships, or life results

  • Any testimonials, examples, or statements of success are illustrative only and do not guarantee similar results

You remain solely responsible for your decisions, actions, and outcomes.

4. Client Eligibility & Global Participation

By using the Services, you represent that:

  • You are at least 18 years of age

  • You are voluntarily participating in coaching

  • You understand that Services are provided from California, USA, regardless of your physical location

We may provide Services globally; however, you are responsible for ensuring compliance with any local laws applicable to you.

5. Coaching Format & Delivery

One-on-one coaching sessions may be delivered via:

  • Video conferencing platforms (e.g., Zoom)

  • Telephone

Session duration, frequency, and package details are disclosed at the time of purchase. We reserve the right to modify delivery methods with reasonable notice.

6. Payment Terms

  • All fees are listed in U.S. Dollars (USD) unless otherwise stated

  • Payment is required in advance of services being rendered

  • If a payment plan is offered, you agree to complete all scheduled payments

  • Failure to make payments may result in suspension or termination of Services

You are responsible for any applicable taxes, currency conversion fees, or bank charges.

Insurance Disclaimer
Coaching services are not psychotherapy, medical treatment, or healthcare services and are not covered by insurance. Clients are responsible for all fees associated with coaching services.

7. Cancellation & Rescheduling Policy

  • Sessions must be canceled or rescheduled with at least 24 hours’ notice

  • Sessions canceled late or missed without notice may be forfeited without refund

  • Repeated no-shows may result in termination of the coaching relationship

8. Refund Policy

Unless explicitly stated otherwise:

  • All sales are final

  • Coaching sessions, packages, and programs are non-refundable once purchased

  • Payment plans do not alter the refund policy

This policy does not limit any non-waivable consumer rights under applicable law.

9. Confidentiality

We maintain the confidentiality of coaching communications to the extent permitted by law.

Confidentiality may be broken if:

  • Disclosure is required by law or court order

  • There is a reasonable belief of risk of harm to you or others

10. Data Privacy & GDPR Compliance

We process personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) for individuals located in the European Union or United Kingdom.

You have the right to:

  • Access your personal data

  • Request correction or deletion

  • Restrict or object to processing

  • Request data portability

Your data may be transferred to and processed in the United States. By using the Services, you consent to such transfers.

11. Intellectual Property Rights & Website Ownership

All content on this website and provided through the Services is the exclusive property of Tracey Sonneborn, DBA theléma Life Coaching or its licensors and is protected by U.S. and international copyright, trademark, and intellectual property laws.

  • Website design, layout, structure, and overall look and feel

  • Text, blog posts, copy, and written materials

  • Logos, trademarks, service marks, and branding

  • Photographs, images, graphics, illustrations, and icons

  • Videos, audio recordings, and downloadable files

  • Coaching materials, worksheets, exercises, and session content

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the website and materials for personal, non-commercial use only.

You may not, without prior written consent:

  • Copy, reproduce, modify, publish, distribute, transmit, display, or create derivative works from any website or coaching content

  • Record, screenshot, scrape, download, or archive website or coaching materials for commercial or public use

  • Share, sell, license, or transfer any content or materials

  • Use any content in connection with coaching, teaching, training, or competing services

Recording of coaching sessions by the client is strictly prohibited without prior written consent.

Unauthorized use may result in legal action.

12. Website Use & Prohibited Activities

You agree to use the website and Services in a lawful, respectful, and appropriate manner.

Prohibited activities include, without limitation:

  • Intellectual property violations

  • Unauthorized access to systems or accounts

  • Introduction of malware or harmful code

  • Disruptive, abusive, or unlawful conduct

  • Misrepresentation or fraud

  • Unauthorized commercial use

  • Privacy or data protection violations

  • Use of Services in violation of applicable laws

We reserve the right to restrict, suspend, or terminate access to the website or Services and to take legal action where appropriate.

16. Dispute Resolution and Governing Law

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Services, the parties agree to first attempt to resolve the matter through good-faith negotiations.

If the dispute is not resolved, the parties shall participate in mediation with a mutually agreed-upon mediator in San Diego County, California, before initiating legal action. Each party shall bear its own costs, and the mediator’s fees shall be shared equally unless otherwise agreed.

No legal action may be initiated unless these negotiation and mediation requirements have been satisfied.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any legal action shall be brought exclusively in the state or federal courts located in San Diego County, California.

17. Force Majeure

We shall not be liable for any delay or failure to perform our obligations due to events beyond our reasonable control, including but not limited to acts of God, illness, natural disasters, power outages, internet or platform failures, or government actions.

18. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms at any time without restriction.

19. Electronic Communications

By using this website or communicating with us electronically, you consent to receive communications from us electronically, including emails, notices, and policy updates, and you agree that such communications satisfy any legal requirement that such communications be in writing.

20. Severability and Waiver

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver.

21. Entire Agreement

These Terms, together with the Privacy Policy and Professional Coaching Disclaimer, constitute the entire agreement between you and the Company regarding use of the website and Services and supersede all prior or contemporaneous communications or agreements.

22. Changes to These Terms

We may update these Terms at any time. Continued use of the website or Services after changes constitutes acceptance of the revised Terms.
